Do I need workers’ comp insurance in Oregon?

There is no “small enough” exemption

People often assume a handful of part-timers puts them below some line. Oregon does not work that way. One subject worker makes you a subject employer, whether they work forty hours a week or four.

The exceptions are specific categories written into statute — certain corporate officers, some domestic work, particular agricultural situations — not a size threshold. If you think you qualify, confirm it with the Workers’ Compensation Division rather than assuming.

Your subcontractors can become your problem

If a subcontractor does not carry their own coverage, their workers can end up counted as yours — and it is usually a premium audit or a claim that discovers this, long after the job is finished.

Collect a certificate of insurance from every sub before they start, and keep it. This is the single most common expensive surprise in contractor policies.

How premium is calculated

Premium is payroll multiplied by a rate tied to your class code, then adjusted by your experience modification factor once you have claims history. Misclassified payroll is the most common reason a business overpays, and it is worth auditing your codes if nobody has looked at them in a few years.

Going without it

Oregon can assess penalties against uninsured employers and hold them directly liable for the cost of a claim. For a small business, one serious injury without coverage is an existential event rather than an expensive one.
